The Arrest of Transgenders in Tripura
On the 8th of January, Four friends from the LGBT community named Mohini, Sangam, Raj, and Tapas went to a part at the city’s hotel, and on their way back home at around 10:40 pm, they were stopped by a few police officials and a reporter only because they were trans. They were bullied and harassed for their appearance and dressing and later arrested for extorting people with fake identities. The arrest was made without any proof.
They were later taken to the West Agartala police station where they were stripped naked in front of male officials to prove their gender. No human is liable to prove their gender to any police officials, this was clearly a violation of human rights as well as the violation of transgender rights.
Even though Mohini and her friends repeatedly pled that they belonged to the LGBT community and what they were doing was against the rights of transgenders but the officials didn’t care about it. These officials who are not even aware of human rights are supposed to be protecting us from crimes, but what should people do when protectors are proving to be worse than criminals?
The officials asked them to submit a written statement mentioning that they will not cross-dress and threatened to arrest them if they did. The worst thing after all this was taking their wigs and inner garments. It is not only illegal but shameful to carry out such an act only because you believe you have the power to intervene in anybody’s life. Crossdressing cannot be a crime in any law. Every individual despite their caste, creed, culture, and group deserves to feel safe because it’s their own country and they have every right to live the way they want.
How can someone’s personality be a reason for crime, transgenders in our society already go through a lot of hustle to survive along with that they do not deserve to be disrespected and shamed for being themselves.
The right to choose one’s gender is crucial to lead a life with respect and dignity which falls under Article 21. The gender of the person is to be determined by the concerned person and the court of India has given people the right to identify gender. Further, they cannot be discriminated based on their gender and if they are then that would be a violation of Article 14,15,16 and 21. In 2014 Supreme court has declared transgender as the third gender and they are to be treated equally like any other gender in society.
A case has been registered against the responsible officials as well as the journalist. Mohini and her friends demand justice for everything that they have been through and so does the LGBT community because such shameful acts affect the entire community as well as their families.
